Indian News Agency ANI Takes Legal Action Against OpenAI for Unauthorised Use of Content in AI Training
Indian news agency ANI sues OpenAI in New Delhi court for unauthorised content use in AI training. OpenAI faces legal challenges globally, with ANI joining other news organisations in lawsuits. ANI accuses OpenAI of attributing fabricated news stories to the agency and using content without permission.
This legal action comes after similar lawsuits in the U.S. by newspapers like the New York Times and the Chicago Tribune.
During the first hearing at the New Delhi High Court, the judge requested OpenAI to provide a detailed response to ANI's claims. ANI stated that the court needs to determine the legitimacy of AI platforms using proprietary content available to the public.
According to court documents reviewed by Reuters, ANI accused OpenAI of attributing fake news stories to the news agency. OpenAI's lawyers in India informed ANI that the agency's website had been blocked internally since September, halting the use of its content for AI model training.
ANI claims that its content is still stored in ChatGPT's memory without being programmed to be deleted, despite OpenAI's decision to stop using their materials. OpenAI defended its practices, stating that it creates AI models using publicly available data in accordance with fair use and legal precedents.
OpenAI, like other tech companies, has faced legal action from various creators for allegedly using their work without permission. ANI claimed that OpenAI did not seek a lawful license for their original works, and expressed concerns about unfair competition as a result of OpenAI's partnerships with news organisations.
The media company noted that OpenAI has licensing agreements with news organisations such as the Financial Times and Associated Press for similar content use. OpenAI mentioned ongoing partnerships with news organisations around the world, including discussions about potential collaborations in India.
The court is scheduled to reconvene on January 28 to further address the case between ANI and OpenAI.
